Terms and Conditions

Last updated: 8 June 2024

1. Who We Are

These Terms and Conditions ("Terms") govern the supply of goods and services by Localinsightnotes ("we", "us", "our") to cafes and other business customers ("you", "the Customer") who order fresh baked goods for delivery through our website or directly by phone or email.

Localinsightnotes is based at 164 Crookes Valley Road, Sheffield, S33 7WX, United Kingdom. You can contact us at any time using the details below:

These Terms are governed by the laws of England and Wales, and by applicable United Kingdom consumer and commercial legislation, including the Consumer Rights Act 2015 (where relevant to any individual acting outside their trade) and the UK General Data Protection Regulation (UK GDPR) as supplemented by the Data Protection Act 2018.

2. Placing and Confirming an Order

Orders may be placed through our website, by email, or by telephone. An order constitutes an offer by you to purchase goods from us. No contract exists until we have confirmed acceptance of your order in writing, typically by email, stating the products, quantities, delivery date, and price.

We reserve the right to decline or amend any order, for example where an item is unavailable, where delivery to your location is not feasible on the requested date, or where the details provided appear incomplete or incorrect. In such cases we will contact you promptly to agree an alternative or to cancel the order without charge.

It is your responsibility to check the confirmation email carefully and notify us immediately of any discrepancy between what was ordered and what was confirmed.

3. Prices, Payment and What Is Included

All prices are quoted in pounds sterling (GBP) and, unless stated otherwise, are exclusive of VAT, which will be added at the applicable rate where required by law. Prices include standard delivery to the address specified in your order confirmation, unless a separate delivery charge is expressly noted.

Payment terms will be confirmed at the time of order and may include payment on invoice, payment on delivery, or advance payment, depending on the arrangement agreed with your business. Recurring supply agreements will specify invoicing frequency and payment due dates in a separate written agreement or order confirmation.

We reserve the right to amend prices for future orders at any time, but any price change will not affect an order that has already been confirmed.

4. Cancellation and Complaints

Because our products are freshly baked and perishable, cancellation requests must be made as early as possible and, in any event, no later than the cut-off time confirmed at the time of ordering. Orders cancelled after production has begun may be charged in full.

If goods arrive damaged, are not as described, or fail to meet an acceptable standard of quality, please notify us within 24 hours of delivery at info@localinsightnotes.com, including photographs where possible. We will investigate promptly and, where a complaint is upheld, will offer a replacement, credit, or refund as appropriate.

Nothing in this section affects your statutory rights under the Consumer Rights Act 2015, where applicable.

5. Limitation of Liability

We take reasonable care in the preparation, handling and delivery of our products. However, to the fullest extent permitted by law, our total liability arising out of or in connection with any order shall not exceed the price paid for that order. We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited.

We shall not be liable for indirect or consequential losses, including loss of profit or loss of business opportunity, arising from delays, supply shortages, or events beyond our reasonable control, including adverse weather, transport disruption, or failure of third-party suppliers.

6. Cookies and Advertising Measurement

Our website uses a single cookie, cookie_consent, which stores your consent preference for one year. No analytics, tracking, or session cookies are set by this site.

Where you have given consent, advertising measurement is activated only on the order confirmation page, solely to assess the effectiveness of advertising that led to a completed order. No measurement activity occurs elsewhere on the site or without your prior consent.

You may withdraw or change your cookie consent at any time through the cookie settings available on our website.

7. Data Protection

We process personal data in accordance with the UK GDPR and the Data Protection Act 2018. For details on how we collect, use, and protect your data, please refer to our Privacy Policy. If you have concerns about how your data is handled, you may also contact the Information Commissioner's Office (ICO), the UK's supervisory authority for data protection.

8. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. The version published on our website at the time of your order will apply to that order.
